Welcome to CyberClair. These Terms of Use (hereinafter "Terms") define the rules for using the CyberClair website and services. By accessing our platform, you accept these Terms without reservation.
1. Definitions
- "Site": The website accessible at cyberclair.io and its subdomains
- "Service": All features offered by CyberClair
- "User": Any person accessing the Site or using the Service
- "Account": Personal space created by the User
- "Publisher": CyberClair, publisher of the Site
2. Purpose of the Service
CyberClair is a cybersecurity platform designed for SMEs and entrepreneurs. The Service offers:
- Personal data breach detection (via HaveIBeenPwned)
- Identification of potentially fraudulent accounts on social media
- Gamified security checklists
- Personalized alerts and recommendations
- Security score and progress tracking
3. Access to the Service
3.1 Access conditions
Use of the Service is reserved for persons who:
- Are at least 18 years old or have authorization from their legal representative
- Have the legal capacity to enter into contracts
3.2 Account creation
Creating an Account requires providing accurate and up-to-date information. The User agrees to:
- Provide truthful information during registration
- Maintain the confidentiality of login credentials
- Immediately notify CyberClair of any unauthorized use of their Account
- Not create multiple accounts for the same person
3.3 Availability
CyberClair strives to ensure Service availability 24/7. However, access may be interrupted for maintenance, updates or force majeure. These interruptions do not entitle to any compensation.
4. Use of the Service
4.1 Permitted use
The User agrees to use the Service:
- Exclusively for their own personal security or that of their business
- In compliance with the law and these Terms
- With respect for the rights of third parties
4.2 Prohibited uses
It is strictly prohibited to:
- Use the Service to monitor third parties without their consent
- Scan emails or social media accounts that you do not own
- Attempt to bypass Service security measures
- Use unauthorized robots, scrapers or automated tools
- Resell or redistribute access to the Service
- Use the Service for illegal purposes (harassment, identity theft)
- Intentionally overload the Service infrastructure
Warning: Any fraudulent or abusive use of the Service will result in immediate Account suspension and may be subject to legal prosecution.
5. Intellectual Property
5.1 CyberClair's rights
All elements of the Site and Service (texts, graphics, software, databases, logos, trademarks) are the exclusive property of CyberClair or its partners.
These elements are protected by French and international laws relating to intellectual property.
5.2 License of use
CyberClair grants the User a non-exclusive, personal, non-transferable and revocable license to use the Service for the duration of their registration.
6. Personal Data
CyberClair collects and processes personal data as part of the Service. This processing is detailed in our Privacy Policy.
By using the Service, the User acknowledges having read this policy and consents to the processing of their data in accordance with it.
7. Liability
7.1 User's liability
The User is responsible for:
- The accuracy of information provided
- The security of their Account and credentials
- The use made of the Service from their Account
- Compliance with these Terms
7.2 CyberClair's liability
CyberClair uses all reasonable means to provide a quality Service. However, CyberClair does not guarantee:
- The complete absence of errors or Service interruptions
- Exhaustive detection of all security threats
- Absolute accuracy of data from third-party sources (HIBP, social media)
- Results obtained by the User following application of recommendations
CyberClair disclaims all liability for damages resulting from non-compliant use or events beyond its control.
8. Hyperlinks
The Site may contain links to third-party sites. CyberClair has no control over these sites and disclaims all responsibility for their content, practices or privacy policies.
9. Modification of Service and Terms
9.1 Service evolution
CyberClair reserves the right to modify, suspend or discontinue all or part of the Service at any time, with or without notice.
9.2 Terms modification
These Terms may be modified at any time. Substantial modifications will be notified to Users by email or via the Site. Continued use of the Service after notification constitutes acceptance of the new Terms.
10. Suspension and Termination
10.1 Suspension
CyberClair may temporarily suspend Account access in case of:
- Suspected fraudulent use
- Terms violation
- Request from a competent authority
10.2 Termination
The User can delete their Account at any time from the My Data page.
CyberClair may terminate the Account in case of serious or repeated Terms violation.
11. Miscellaneous Provisions
11.1 Partial nullity
If any provision of these Terms is declared null by a court decision, the other provisions remain in force.
11.2 Entirety
These Terms, the Privacy Policy, the Cookie Policy and the Terms of Sale (for paying subscribers) constitute the entire agreement between the User and CyberClair.
11.3 Non-waiver
Failure by CyberClair to exercise a right under these Terms does not constitute a waiver of that right.
12. Governing Law and Jurisdiction
These Terms are governed by French law.
In case of dispute, the parties agree to seek an amicable solution. Failing that, the French courts will have sole jurisdiction.
