Terms of Sale

1. Preamble and Definitions

These Terms of Sale (hereinafter "Terms") govern the contractual relationship between CyberClair and any user subscribing to a paid subscription.

  • "Publisher": ID Cyberconseil, micro-enterprise located in La Réunion, France (SIRET: 98969428600018)
  • "Customer": Any natural or legal person subscribing to a paid subscription
  • "Service": Cybersecurity services offered by CyberClair
  • "Subscription": Paid plan providing access to premium features

2. Purpose

These Terms define the conditions under which CyberClair provides its cybersecurity services to Customers who have subscribed to a paid plan.

3. Access to the Service

Access to the Service requires:

  • Creating a user account
  • Accepting these Terms and the Terms of Use
  • Subscribing to a paid plan to access premium features
  • A working internet connection

4. Description of Plans

4.1 Free Plan (Freemium)

The free plan provides access to a limited set of features:

  • Initial data breach scan (limited)
  • Basic security score
  • Access to Bronze level checklists

4.2 Monthly Subscription

The monthly subscription provides access to all premium features:

  • Unlimited data breach scans
  • Fake account detection on social media
  • Real-time alerts
  • Access to all checklists (Bronze, Silver, Gold, Diamond)
  • Priority support

4.3 Annual Subscription

The annual subscription offers the same features as the monthly subscription with a discount on the overall price (equivalent to 2 months free).

5. Prices and Payment Terms

5.1 Prices

Prices are displayed in euros (€) including all taxes. As CyberClair is a micro-enterprise, VAT is not applicable (Article 293 B of the French Tax Code).

Current prices are displayed on the site's subscription page. CyberClair reserves the right to modify its prices at any time. Any change will be notified to Customers at least 30 days before it takes effect.

5.2 Payment methods

Payment is made exclusively by credit card via our secure provider Stripe, PCI-DSS Level 1 certified.

Accepted payment methods:

  • Visa credit card
  • Mastercard credit card
  • American Express credit card

5.3 Invoicing

An invoice is automatically generated and sent by email for each payment. You can also access your invoices from the Stripe customer portal.

6. Duration and Renewal

6.1 Duration

  • Monthly subscription: One-month duration, automatically renewed
  • Annual subscription: 12-month duration, automatically renewed

6.2 Automatic renewal

Unless cancelled by the Customer, the subscription is automatically renewed at its end for an identical duration. The corresponding amount will be charged to the registered payment method 24 hours before the renewal date.

A reminder email is sent 7 days before each renewal.

7. Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, you have a 14-day period from subscription to exercise your right of withdrawal, without having to justify reasons or pay penalties.

To exercise this right, you can:

In case of withdrawal within the legal period, you will be refunded all amounts paid within 14 days of notification of your decision.

The refund will be made using the same payment method as the initial transaction.

Exception: In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised if you have expressly requested the start of service execution before the end of the withdrawal period and acknowledged waiving this right.

8. Cancellation

8.1 Cancellation by Customer

You can cancel your subscription at any time from your account area ("Subscriptions" section) or by contacting our support.

Cancellation takes effect at the end of the current subscription period. You retain access to premium features until that date.

8.2 Cancellation by CyberClair

CyberClair reserves the right to immediately cancel the subscription in case of:

  • Violation of Terms of Sale or Terms of Use
  • Fraudulent use of the service
  • Payment default after unsuccessful formal notice

9. Liability and Guarantees

9.1 CyberClair's obligations

CyberClair commits to:

  • Provide a service conforming to the plan descriptions
  • Ensure service availability (excluding scheduled maintenance)
  • Protect personal data in accordance with GDPR
  • Inform the Customer of any substantial service modification

9.2 Limitation of liability

CyberClair provides detection and alert tools but does not guarantee:

  • Exhaustive detection of all cyber threats
  • Absence of false positives in alerts
  • Automatic resolution of detected security issues

CyberClair's liability is limited to the amounts actually received for the subscription over the last 12 months.

10. Intellectual Property

The subscription grants the Customer a personal and non-exclusive right to use the Service. All Service elements (software, design, content) remain the exclusive property of CyberClair. Any reproduction, distribution or commercial use is prohibited.

11. Data Protection

Personal data processing is detailed in our Privacy Policy. By subscribing, you acknowledge having read this policy.

13. Governing Law

These Terms are governed by French law. In case of dispute, and failing amicable resolution, the French courts will have sole jurisdiction.

14. Terms Modification

CyberClair reserves the right to modify these Terms at any time. Changes will be notified by email at least 30 days before their effective date. Continued use of the Service after this date constitutes acceptance of the new Terms.
